Compliance requirements
The bidder must confirm that neither it nor its representatives have relevant final convictions within the past five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. Exclusion may also apply for unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, similar proceedings, administration of assets by a liquidator or court, or suspended business activity; serious professional misconduct; anti-competitive agreements; an unmanageable conflict of interest; involvement in preparing the procurement where an advantage cannot otherwise be avoided; significant or repeated failures under previous contracts resulting in early termination, damages or comparable sanctions; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the procedure. The national grounds also include enabling a foreign national to work without legal grounds or in breach of employment conditions, and being subject to international sanctions. The bidder must confirm that it has no tax or social security debt; the stated threshold is EUR 0, with the notice explaining that a tax debt certificate is not issued for debts under EUR 100 or where payment has been deferred. Where an exclusion ground applies, information about remedial measures may be provided where permitted.
