Compliance requirements
The bidder must declare whether it or its representatives have relevant convictions within the past five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and human trafficking. Grounds also cover tax or social security arrears; bankruptcy, insolvency, liquidation, suspended business activity or comparable situations; serious professional misconduct; anti-competitive agreements; conflicts of interest or involvement in preparing the procurement; serious or repeated failures under previous contracts; and false or misleading statements, withholding required information or documents, or improperly obtaining confidential information. Environmental, social and labour-law breaches are also covered. A mandatory national ground concerns enabling the unlawful employment of a foreign national; other national grounds include international sanctions and tax offences. Where a ground applies, the bidder may provide information about measures taken to restore its reliability where permitted.
Tax and social security arrears are grounds for exclusion. The stated threshold is EUR 0; however, under Estonian rules a tax-debt certificate is not issued where the debt is below EUR 100 (excluding interest not fixed by an administrative act) or payment has been deferred. Foreign bidders are assessed under the rules of their country of establishment. The bidder must also confirm that the goods are not subject to international sanctions or from sanctioned regions, and that prohibited Russian-linked subcontractors or suppliers will not be involved in performing more than 10% of the contract value. A contract that would breach applicable international or Estonian sanctions will not be concluded.
