Occupational health services

The bidder must confirm that none of the exclusion grounds under subsection 1 of § 95 of the Estonian Public Procurement Act apply; the contracting authority may exclude a bidder where the grounds under subsection 4 of § 95 apply. Participation is limited to undertakings established or resident in Estonia, another European Union or European Economic Area country, or a country that has joined the World Trade Organization Government Procurement Agreement. The bidder must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia, entities directly or indirectly more than 50% owned by such persons or entities, or representatives acting on their behalf or under their instructions. The bidder must also confirm that it will not use a subcontractor subject to replacement because of exclusion grounds. In a joint tender, a power of attorney for the authorised representative of the joint tenderers must be submitted.

The bidder, or the joint tenderers together, must independently have previous experience in providing occupational health services: during the 36 months preceding publication of the procurement, at least one such contract or order must have been duly completed, with the total value of the contract or contracts being at least EUR 200,000 excluding VAT. The experience must be submitted using Form A. If the information cannot be verified free of charge in public databases, the bidder must, at the contracting authority’s request and within a period of at least five working days, provide written confirmation from the client that the contract was duly performed. Experience may not be obtained from an external entity under § 103 of the Estonian Public Procurement Act; joint tenderers may rely on each other’s credentials. The tender must include the prices of the health examination package and additional services using Annex 2 to the framework agreement. Conditional tenders are not permitted, and the tender must remain valid for at least 90 days. The service provider must have, or be able to use by the time the contract is signed—approximately one month after submission—a functioning self-service environment for managing health examinations. Form B must provide its web address, a description of its functionality and, where applicable, information on the expected readiness date or the use of a third-party environment. The provider must be able to deliver services on a stationary basis in at least Tallinn and Tartu. The proposed method for serving employees in Pärnu, Tapa, Jõhvi, Võru, Paldiski and Ämari must be described and may be agreed during the procurement procedure where necessary. Form B must include the service locations and contact details, including the legal basis for the authority of the person signing the contract and the persons involved in contract performance.
