Compliance requirements
The bidder must declare whether it or its relevant representatives have qualifying convictions, including for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, terrorist financing, child labour or human trafficking. Exclusion grounds also cover unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activity; serious professional misconduct; competition-distorting agreements; conflicts of interest or involvement in preparing the procurement that cannot be resolved; significant or persistent breaches of previous contracts; false or misleading information, failure to provide required information or documents, and attempts to obtain confidential information or improperly influence the procedure. Other grounds include breaches of environmental, social or labour obligations, unlawful employment of foreign nationals, relevant tax offences, international sanctions, and any applicable restriction on the bidder’s country of establishment. Where legally available, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least one similar supply contract or order during the 36 months preceding the start of the procurement. The contract must be worth at least EUR 20,000 excluding VAT and involve the purchase and installation of a stationary generator. For ongoing contracts, only the value of goods or services handed over to and accepted by the customer by the start of the procurement may be counted; for contracts partly completed before the 36-month reference period, only the value completed within that period counts. The bidder must provide a brief description, performance period, contract value and details of the customer, including a contact person’s telephone number and email address; for public contracts, include the procurement reference number. The contracting authority may request customer confirmations and may contact the customers named in the ESPD to verify the experience. No specific financial-capacity threshold is stated. The bidder must confirm that it holds any registrations and qualifications required by law and the technical specification, and provide supporting explanations or documents before contract award if requested.
