The bidder must not be subject to any grounds for exclusion. The notice checks, among other matters, final convictions involving the bidder, members of its management or supervisory bodies, and authorised representatives for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. The bidder must also have no outstanding tax or social security payment obligations, no relevant breaches concerning the employment of illegally staying foreign nationals, and no obstacles related to international sanctions. The bidder must provide the declarations required in the ESPD and, where applicable, supporting evidence. Where an exclusion ground exists, evidence of remedial measures restoring reliability may be submitted in certain cases.

The machine-readable ESPD does not specify precise requirements concerning turnover, previous experience, staffing or professional qualifications; these should be checked in the tender documents if applicable. To demonstrate compliance, the bidder must provide a finished sample meeting the technical specification for each product in the required size, deliver the samples by the deadline to Paldiski mnt 80, Tallinn, and provide measurement tables both in the sample package and digitally in the register. Failure to provide the samples results in rejection, and the samples must be the same products that the bidder would supply under the contract. Products worn next to the skin, particularly shirts, trousers and skirts, must have OEKO-TEX® Standard 100 certification or the EU Ecolabel, and the relevant certificate or other required document must be submitted with the bid. The bidder must ensure that all garment parts and accessories, such as zippers, buttons and fasteners, remain available throughout the contract period and can be used for warranty repairs. Large collective packaging must be used for transport; where individual packaging is required, it must be made of 100% recycled material or be biodegradable. The bidder must submit the price form showing the price per item for each garment; the total on lines 1–8 must match the total price entered in the register. For a joint bid, a power of attorney for the joint bidders must be included. The bid must comply with all tender document requirements and must not be conditional.
