Compliance requirements
The bidder must declare whether it or any person authorised to represent, manage or control it has relevant convictions, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, child labour or human trafficking. The grounds also cover breaches of tax or social security payment obligations; bankruptcy, insolvency, liquidation, creditor arrangements, asset administration or suspension of business; breaches of environmental, social or labour obligations; serious professional misconduct; competition-distorting agreements; unresolved conflicts of interest or involvement in preparing this procurement; serious or repeated failures under earlier contracts; false or misleading information, withheld information, failure to provide requested documents, or attempts to obtain confidential information or improperly influence the procedure. National grounds include enabling the unlawful employment of a foreign national, being subject to international sanctions, tax offences, and restrictions on eligibility based on the bidder’s place of establishment. Where a ground applies, the bidder may provide information about remedial measures if the applicable rules permit this.
Qualification criteria and exclusion grounds
The bidder must have completed at least two contracts during the 36 months preceding the start of the procurement for software solutions developed or further developed on the Microsoft .NET platform. The solutions must operate online as web-based systems; at least one must use an SQL database and at least one must be integrated with other information systems through X-Road. The stated aggregate contract value is at least EUR 200,000 excluding VAT; the source also spells this amount out as EUR 250,000, so the discrepancy should be clarified in the tender documents. The bidder must list the relevant contracts, describing the work, value, dates, client and its own responsibilities, and provide client confirmations if requested. Ongoing contracts may count to the extent that the relevant work has been completed. A bidder relying on another entity’s capacity must identify that entity, submit its tender passport and the required consent form, and ensure that it participates directly in performing the part for which its capacity is relied upon.
The tender must include a solution to the test assignment and a completed, signed commitment form for each team member involved in contract performance. The hourly price for maintenance and development must be entered in the specified pricing structure, to two decimal places; it must include all costs, and zero or negative prices and cross-subsidisation are prohibited. Conditional tenders are not allowed. The bidder must confirm compliance with the tender documents and explain and evidence any claimed equivalence. It must also make the required declarations concerning environmental obligations, sanctions, authorised representatives and trade secrets. Joint bidders must appoint an authorised representative and submit their authorisation. The bidder must not involve, for more than 10% of the contract value, subcontractors or suppliers falling within the specified Russian ownership, establishment or control categories.
