Compliance requirements

A tenderer may be excluded if it has outstanding tax arrears under the tax laws of Estonia, including state taxes, contributions or environmental charges, or outstanding taxes or overdue social security contributions under the laws of its country of establishment. Agreed payment schedules for tax arrears are accepted. A tenderer established outside Estonia must be ready to provide evidence from its tax authority; submitting tax records or confirmation with the tender is encouraged to speed up verification. The contracting authority may also exclude tenderers from countries that are not EU Member States, EEA Agreement countries or parties to the WTO Government Procurement Agreement, and with which the EU has no reciprocal free trade agreement covering public procurement. The tenderer must state its country of origin.

Qualification criteria and exclusion grounds

The tenderer must have delivered at least one CNC folding center to a client during the 36 months before the procurement began. The tenderer must provide the client’s name and contact details, a brief description of the machine, and the acceptance date, stated by month and year. The tenderer must submit a comprehensive price offer or bill of quantities showing the proposed solution, equipment specifications, scope of work and pricing structure. The tenderer must complete Annex 1, Technical Requirements, and provide the equipment’s technical specifications and, where necessary, drawings identifying its main parts and the manufacturers of its main components. Any proposed equivalent must be explained and supported by evidence. The warranty must be at least 12 months or 1,500 working hours from acceptance. The tenderer must accept the payment schedule: 30% after contract conclusion, 50% before delivery (the buyer may request proof that the equipment is ready for delivery), and the final 20% after all work has been completed and accepted. Each invoice must allow at least 14 calendar days for payment. For technical problems, the tenderer must respond remotely within one working day after notification. If needed during the warranty period, an on-site technician must arrive at the buyer’s production premises within two working days. These response periods apply on working days, Monday to Friday, between 08:00 and 16:00 Estonian time. Notifications received outside those hours are treated as received at 08:00 on the next working day; the obligation does not apply on weekends or public holidays. The tenderer must ensure that a service representative responsible for maintenance and technical support is based in Estonia throughout contract-related work and the warranty period. The representative may be the tenderer, its official representative or a partner, and must be ready to provide the service in Estonia no later than handover of the equipment. The tenderer remains responsible for these obligations. The tenderer must also accept the contractual penalties set out in section 2.2 of the Procurement Document. For a joint tender, the tenderers must appoint an authorised representative and include their power of attorney. The tender must be unconditional and comply with the procurement documents. The price must follow the structure specified in the pricing schedule. The tenderer must identify and justify any claimed trade secrets; prices and evaluation-related figures or characteristics may not be designated as trade secrets.
