The bidder must confirm that the bidder, its management and supervisory board members, and its authorised representatives have not been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, illegal use of child labour or human trafficking-related offences. The exclusion grounds also cover tax or social security debts, breaches of environmental, social and labour law, bankruptcy or another insolvency situation, suspended business activities, serious professional misconduct, agreements restricting competition, conflicts of interest, prior involvement in preparing the procurement, material breaches of previous contracts, and the submission of false information or failure to provide required documents. National exclusion grounds also apply in relation to enabling the employment of unlawfully staying foreign nationals, international sanctions and tax offences. Tax and social security obligations must have been paid or covered by a binding payment agreement. Where an exclusion ground exists, the bidder may submit evidence of remedial measures restoring its reliability where applicable. The bidder must provide the required declarations and, where requested, evidence concerning the exclusion grounds.

The economic operator must be registered in the commercial register or an equivalent register in its country of establishment. At the contracting authority’s request, a copy or extract proving registration must be submitted, unless the information on an undertaking registered in Estonia is publicly available to the authority through the commercial register. The service team must include at least one person with either at least five years of experience in the technical management and internal logistics of an opera and ballet theatre with a permanent company, experience in establishing an opera house from the initial concept to completion as the responsible project manager, or equivalent experience as the client’s representative. The bid must state the person’s name, the opera house and its address, the employer, the employment or assignment period, and the person’s duties or areas of responsibility. The team must include at least one authorised architect holding an authorised architect qualification, or equivalent qualification, obtained in a European Economic Area member state or Switzerland, and experience during the last 15 years as the responsible architect in designing a performing arts venue or a building with an equivalent use. The reference building must have a use permit or an equivalent document proving compliance with the requirements applicable in its country. The bidder must provide the professional certificate number and the relevant reference project, design, client and register details. At least one team member must have experience gained during the last 15 years in preparing a space programme and volume analysis for a public building. The bidder must provide details of the person and the reference service, building, floor area, period, client and register information. At least one team member must have competence in preparing special heritage protection conditions for spatial planning or in preparing conservation and restoration construction projects, or equivalent competence in the relevant country. The bidder must provide the person’s name, licence or competence certificate number and, where available, a link to the relevant public register. The persons referred to in points 2, 3 and 4 may be the same person if their qualifications and experience meet all applicable requirements. The bid must include a description of the analysis methodology, action plan, timetable and division of work, with a maximum length of 10 A4 pages. The description must be anonymous and replace individual names with role titles. The bid must comply with the tender documents, contain all required documents and follow the required structure; conditional bids are not permitted. In a joint bid, a power of attorney must be submitted, and, where the bidders rely on one another’s resources, the size and nature of the contract parts performed by each joint bidder must be indicated. The bidder must also provide the details of authorised persons who are not visible in the procurement register check, or confirm that no such persons exist.
