Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must declare whether it or any person with powers of representation, decision-making or control has, within the applicable period of up to five years or while an exclusion period remains in force, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. The bidder may provide evidence of measures taken to restore its reliability where permitted. Exclusion grounds also cover unpaid taxes or social-security contributions; bankruptcy, insolvency, liquidation, suspended business activity or comparable situations; serious professional misconduct; agreements with other businesses intended to distort competition; an unmanageable conflict of interest; involvement in preparing this procurement that creates an unremediable competitive advantage; serious or repeated breaches of earlier contracts resulting in early termination, damages or comparable sanctions; false or misleading information, withholding required information or documents, and improper attempts to obtain confidential information or influence the contracting authority. Tax or social-security debt is generally relevant, but the notice explains that a tax-debt certificate is not issued for debt below EUR 100, excluding interest not established by an administrative act, or where payment has been deferred. National grounds include enabling a foreign national to work without a legal basis or in breach of employment conditions, including payment below the legally prescribed wage; entering into a contract in breach of international or Estonian government sanctions; and conviction for tax offences. The bidder must also confirm compliance with applicable international sanctions. The authority will reject a bid where the resulting contract would be void under sanctions law.

Qualification criteria and exclusion grounds

For each product offered in lots 1–25, the bidder must have sold that product during the three years preceding publication of the contract notice in a quantity of at least one third of the planned quantity for that product over the framework-agreement period. The bidder must provide a list of completed sales contracts or transactions identifying the product and lot, quantities sold, contract dates and values, and the other contracting parties; the information and confirmation must be included in the European Single Procurement Document (ESPD). The bidder must have the right to sell the offered products in Estonia and provide evidence from the manufacturer or, where the manufacturer is outside the EU, its authorised representative. Any further delegation of that right must also be documented. The bidder must identify a product representative who is employed or engaged under another contractual arrangement and has received manufacturer training or training on the offered products; on request, the bidder must provide training certificates or written confirmation from the manufacturer. The offered products must match the product descriptions and technical requirements. The bid must include the completed technical and price schedule in Excel format, with each product’s exact name, manufacturer, product code or reference number, descriptions and actual parameters. Prices must be in euros to two decimal places, stated by lot and for each product and lot total, and include delivery and unloading costs; unit prices must be final, with no additional charges. Conditional bids are not permitted. The bidder must provide manufacturer-issued technical specifications, instructions for use and other informative materials in Estonian or English that demonstrate compliance; explain any company-specific terms. Products must bear CE marking and comply with Regulation (EU) 2017/745 or its transitional provisions. Provide applicable certificates of conformity or declarations of conformity, highlighting the offered products if listed with others. Packaging must identify the product, manufacturer, product code, size, package quantity, sterility and batch or serial number, along with other traceability information. Provide management-approved procedures describing delivery and transport storage conditions. Samples must be submitted with the bid in sterile original packaging labelled with the product name and code or reference number, and packed with the procurement title, reference number and lot number. Samples are not required for products used at Tartu University Hospital under a contract with the bidder during the three years before publication of the contract notice. Samples are not returned. If requested for practical testing, additional samples must be delivered within three working days. For a joint bid, submit the authorisation and confirmation of joint and several liability; submit the participation declaration and identify any information claimed as a trade secret, with reasons. Price information and other evaluation figures may not be designated as trade secrets. The bidder must also confirm that the bid complies with the procurement documents and explain and substantiate any equivalent products offered. No award criteria are specified in the provided text.
