Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder and its representatives must declare whether, within the relevant period, they have final convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion may also apply for unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an analogous situation, administration of assets or suspension of business; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an advantage which cannot otherwise be remedied; serious or persistent failures under a previous public contract resulting in termination, damages or comparable sanctions; false or misleading information, failure to provide required information or documents, or improper attempts to influence the procedure or obtain confidential information. National grounds also include enabling an unlawfully present foreign national to work, being subject to an international sanction, and convictions for tax offences. A bidder may, where legally permitted, submit evidence of measures taken to restore its reliability. The notice describes tax and social contribution arrears as grounds for exclusion, while noting that an Estonian tax-debt certificate is not issued for debt below EUR 100 or where payment has been deferred.

Qualification criteria and exclusion grounds

The tender documents set out the following qualification and compliance requirements: - The bidder’s net turnover must have been at least EUR 8,000,000 in each of the three most recently completed financial years before the procurement began. Where the financial year follows the calendar year, the relevant years are 2023, 2024 and 2025. The bidder must state the turnover for each year in the European Single Procurement Document (ESPD). - The bidder must have properly completed at least one similar construction contract during the 60 months before the contract notice was published in the national procurement register. The bidder must have acted as the main contractor on works involving a building, part of a building or a building complex with at least 1,000 m² of enclosed net floor area. The works must have involved construction or extension, or full reconstruction, including load-bearing structures and external envelope, interior works, central heat-recovery mechanical ventilation, central cooling, central building automation, a new electrical system and a new low-voltage system. The bidder must provide contract details in the ESPD; the contracting authority may request a client confirmation that the works were properly performed. - The bidder must have a quality management system for construction works meeting at least ISO 9001 or equivalent requirements, supported by evidence from an independent body. It must also have an environmental management system for construction works meeting at least ISO 14001 or equivalent requirements, supported by evidence from an independent body. - The construction project manager must hold at least a level 7 Chartered Construction Engineer qualification, specialising in building construction with the broad competence of construction management, or an equivalent qualification. The site manager must be a different person and must be present at the site throughout the working day while construction is underway. The site manager must hold either a level 6 Construction Engineer qualification specialising in building construction with broad construction-management competence, or a level 6 Construction Manager qualification in general construction without restrictions and covering masonry and concrete, timber and steel structures, demolition and facade works, or an equivalent qualification. Initial qualifications based solely on education are not accepted. The bidder must provide the specialists’ details using Form 4. For qualifications obtained outside Estonia, submit the qualification document and a document from the competent Estonian authority confirming its equivalence. - The bidder must submit the participation application using Form 2, including subcontractor details and, where applicable, a reasoned list of documents claimed as trade secrets. The price must be stated in euros, excluding VAT, both in the procurement system and in the completed Form 3 price table; if the totals differ, the amount calculated from Form 3 prevails. A joint bid must include a representative’s authorisation and confirmation of joint and several liability using Form 8. - The offer must comply with the tender documents. Where an equivalent product, method or standard is proposed, the bidder must explain and substantiate the equivalence. The documents also require furniture to have a warranty of at least 5 years, including repair and a replacement product during repairs, and availability of spare parts or functionally equivalent components for at least 5 years after handover. Disassembly and repair instructions must be supplied, along with a declaration or list of REACH candidate substances present above 0.1% by mass, or confirmation that the products contain none above that threshold. Wood and wood-based materials must come from legal sources, supported by FSC, PEFC, CSA, SFI, FLEGT or CITES documentation as applicable, or equivalent evidence; for uncertified wood, provide its species, quantities and origin and confirm legality and traceability. - If access-restricted technical documents are required, the bidder must first request them and provide the required information-protection confirmation. The bidder must confirm that neither it nor any entity whose capacity it relies on is established or resident in Russia or Belarus.
