Compliance requirements
The bidder may be excluded for final convictions within the last five years, or while an exclusion period remains in force, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. Exclusion may also apply for breaches of tax or social security payment obligations; bankruptcy, insolvency, liquidation or similar proceedings; assets administered by a liquidator or court; suspended business activity; or an arrangement with creditors.
Other grounds include serious professional misconduct; agreements with other businesses intended to distort competition; an unresolved conflict of interest or involvement in preparing this procurement that creates an unfair advantage; serious or repeated breaches of previous contracts resulting in early termination, damages, price reductions or comparable penalties; false or misleading information, withholding required information or documents, or seeking confidential information to gain an improper advantage; and breaches of environmental, social or labour-law obligations. National grounds also include enabling a foreign national without legal residence status to work, being subject to an international sanction, and certain tax-related convictions. For tax debts in Estonia, the notice explains that a tax-debt certificate is not issued where the debt is below EUR 100 or payment has been rescheduled. Where a ground applies, the bidder may provide evidence of measures taken to restore its reliability if the applicable rules allow this.
