Compliance requirements
The bidder must declare whether it or its representatives have relevant final convictions, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. The grounds also cover unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation or comparable situations; serious professional misconduct; competition-distorting agreements; conflicts of interest or involvement in preparing the procurement where these cannot otherwise be addressed; serious or repeated failures under previous contracts; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information improperly. National grounds include enabling a person without legal grounds to work, being subject to applicable international sanctions, and convictions for tax offences. Tax or social security arrears below €100, or arrears whose payment has been deferred, are treated as specified in the tender documents. Where permitted, the bidder may describe measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have properly performed, during the 36 months preceding the start of the procurement, at least one contract for winter maintenance of roads and/or paved areas that included snow clearance over a maintained area of at least 15,000 m². Completed and ongoing contracts may be counted if the required service volume has been properly delivered. Provide the service description, maintained area, contract value, service period and client’s name.
The bidder must have at least four four-wheel-drive machines suitable for snow clearance, each with a gross weight of at least 1,500 kg. By the tender submission deadline, provide each machine’s make, model, gross weight, drivetrain and the legal basis for its use. If a machine is not owned by the bidder, provide a written agreement or other evidence that it will be available to the bidder for contract performance. The machines must be ready for use by the start of the service.
For a joint tender, the joint bidders must appoint an authorised representative and provide the relevant authorisation. The bidder must confirm that its tender complies with the procurement documents, that it is not conditional, and that the price is submitted in the prescribed structure. First-tier subcontractors are checked during contract performance and must submit a European Single Procurement Document (ESPD).
