Compliance requirements
The bidder must confirm that neither it nor its relevant representatives have applicable convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking, or tax offences. Grounds also include unpaid taxes or social security contributions; for Estonian tax debts, amounts below EUR 100 and debts whose payment has been deferred are treated as described in the notice.
Other grounds include bankruptcy, insolvency, liquidation, an equivalent proceeding, creditor arrangements, assets administered by a liquidator or court, suspended business activity, and serious breaches of environmental, social, labour or professional obligations. Grounds further cover serious professional misconduct, competition-distorting agreements, an unmitigable conflict of interest, improper involvement in preparing the procurement, significant or persistent failures under previous contracts, false or misleading information, failure to provide required information or documents, and attempts to obtain confidential information improperly. The bidder must also not have enabled the unlawful employment of a foreign national, and entering into the contract must not breach international or Estonian sanctions. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 200,000 in each of the two most recently completed financial years. If the financial year coincides with the calendar year, the relevant years are 2025 and 2024; the bidder must provide the turnover figures in the procurement passport.
Within the 60 months preceding publication of the contract notice in the national procurement register, the bidder must have completed at least one contract involving owner’s supervision services for a similar property. A similar property is a building with more than 1,500 m² of enclosed net floor area used as a prison, rescue or police facility, border guard, security or customs facility, a military-defence facility, or an office building. The bidder must provide the contract details, including the contracting parties and contact details, building and floor area, contract term and, where applicable, the procurement reference number.
The services must be delivered by a responsible owner’s supervision specialist holding at least a Level 7 Chartered Construction Engineer qualification, specialising in building construction and with the selected competence of owner’s supervision, or an equivalent qualification. Initial qualifications based solely on education are not accepted. The bidder must provide the specialist’s details using Form 4. For qualifications awarded outside Estonia, submit the qualification document and a document issued by a competent Estonian authority confirming its equivalence to the required qualification.
The bidder must submit the participation application using Form 2, and provide a separate list of documents designated as trade secrets with reasons for that designation. The offer must adopt all requirements in the procurement documents and include the price in euros, excluding VAT, both in the procurement system and in the Form 3 price table; if the totals differ, the Form 3 total prevails. The bidder must request any access-restricted technical documents and confirm that the restricted information will be protected. Joint bidders must appoint a representative and submit the power of attorney and confirmation of joint and several liability using Form 8. The bidder and any entity whose capacity it relies on must not be established or resident in Russia or Belarus.
