Compliance requirements
A bidder may be excluded for final convictions within the previous five years involving participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also cover tax or social-security contribution arrears; bankruptcy, insolvency, liquidation or similar situations; assets administered by a liquidator or court; and suspended business activities.
Other grounds include serious professional misconduct; agreements with other businesses intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement where an advantage cannot otherwise be prevented; serious or repeated breaches of earlier public contracts leading to early termination, damages or comparable sanctions; and false or misleading information, omission of required information or failure to provide requested supporting documents. Exclusion may also follow from breaches of environmental, social or labour obligations. National grounds include enabling a foreign national to work without a legal basis, being subject to an international sanction, and conviction for tax offences. For relevant grounds, the bidder may provide evidence of measures taken to restore its reliability where the law or tender documents allow this.
Qualification criteria and exclusion grounds
The supplier must be entered in the relevant business register. It must also have submitted a notice of economic activity in Estonia for the sale of gas, or hold an equivalent registration or authorisation under the law of its country of establishment. A supplier established outside Estonia must provide evidence of that registration or authorisation from the competent authority.
The supplier’s average annual turnover for the last three completed financial years, 2023–2025, must be at least EUR 600,000. On request, if the information is not available through a public register, the supplier must provide its annual accounts for those three years or extracts from them.
During the 36 months preceding the start of the procurement, the supplier must have completed at least two natural-gas sales contracts, each worth at least EUR 300,000 excluding VAT. The documents also instruct suppliers to list contracts worth at least EUR 500,000 excluding VAT; this differs from the stated minimum contract value and should be checked in the tender documents. The contract list must include values, dates, details of the other contracting parties and their representatives’ contact details, and procurement reference numbers where applicable.
The bid must follow the required price-table structure and include, to two decimal places and excluding VAT, the fixed-price gas sales price per MWh and the supplier’s service fee per MWh for the market-price package. The market-price package is calculated as GH = TTF + Z, where TTF is the TTF ICE month-ahead index and Z is the supplier’s fee. The lowest total price is selected using PK = FIX + 50 × Z; if the lowest total prices are tied, the lower fixed-price package price prevails. Conditional bids are not permitted, and submission confirms acceptance of all tender-document conditions. Joint bidders must appoint an authorised representative and include the power of attorney. The supplier must confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions.
