Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must not have been convicted, nor must its relevant directors, managers, supervisory body members, authorised representatives or controllers have been convicted, of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorist offences or related conduct, money laundering or terrorist financing. The same applies to convictions for enabling the unlawful employment of a foreign national or breaching the conditions for a foreign national’s employment in Estonia, including paying less than the statutory minimum wage, and for unlawful use of child labour or human trafficking. A bidder with outstanding national taxes, fees or environmental charges, or tax or social security contribution debts under the law of its country of establishment, is excluded. The contracting authority may also exclude a bidder that has seriously or persistently breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has provided false information about meeting qualification requirements or failed to provide that information or requested supporting documents. An undertaking established or resident in the Russian Federation or Belarus may not participate in the procurement.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 50,000 in each of the last two completed financial years. The bidder must provide extracts from the annual accounts for those years showing net turnover, unless the information is publicly available to the contracting authority in a register for a bidder registered in Estonia. If the financial year does not coincide with the calendar year, the requirement applies to the last two completed financial years. At least six months must have elapsed since the end of the last completed financial year by the bid submission date. The bid must include the completed price quotation table, with the unit-price field marked in green filled in, and the completed technical questionnaire for the integrated arc-suppression-coil grounding transformer. All fields in the technical questionnaire must be completed; partial completion may result in rejection. The offered equipment must have a warranty of at least 24 months from handover to the contracting authority or its authorised contractor. The bidder must provide the name, title and contact details of each person signing the contract, together with the contact person’s name, title and contact details for contract-related matters. If the signatory’s authority does not arise from the articles of association, a power of attorney must be included. Payment is due within 14 calendar days of receipt of the invoice for contracts up to EUR 59,999; within 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and within 45 calendar days for contracts of EUR 250,000 or more. If the bidder joins the contracting authority’s factoring programme, the payment term is 95 calendar days from receipt of the invoice. The bidder must identify and justify any trade secrets in the bid, or state that it contains none. The bid price and component prices, as well as specified figures or characteristics used for evaluation, may not be designated as trade secrets. The bidder must confirm that the bid complies with the procurement documents and explain any equivalence where relevant, providing supporting evidence. References to standards, products, brands or other specified sources are understood to allow equivalent alternatives, subject to the evidence requirements in the procurement documents. Materials, equipment, goods and components installed or used must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. The notice documents provided do not specify the award criteria.
