Compliance requirements
The bidder may be excluded for relevant final convictions of the bidder or its management, supervisory or representative persons, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. The notice covers convictions within the previous five years or an exclusion period that remains in force. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, suspension of business or comparable situations; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; and serious or repeated failures under previous contracts resulting in early termination, damages, price reductions or penalties. A bidder may also be excluded for false or misleading information, withholding information, failing to provide requested supporting documents, or improperly seeking confidential information or influencing the procurement decision.
National grounds include enabling a foreign national to work without a lawful basis or in breach of applicable employment conditions, including paying less than the legally required wage; being subject to international sanctions in a way that would make the contract unlawful; relevant tax-offence convictions; and any applicable local-tax debt or restriction on participation based on the bidder’s place of establishment. For tax and social security debts, the notice states that an Estonian tax-debt certificate is not issued where the debt managed by the same tax authority is under EUR 100, excluding interest not established by an administrative act, or where payment has been rescheduled.
Qualification criteria and exclusion grounds
For all three lots, the bidder must be entered in a commercial register and hold a valid environmental permit for the service. For each lot, the bidder must also demonstrate relevant treatment experience completed in the 36 months before the procurement began; a properly performed part of an ongoing contract may count. Experience in waste collection and transport alone is insufficient.
- Lot 1, mixed municipal waste: at least one contract involving the treatment of at least 1,000 tonnes of mixed municipal waste (waste code 20 03 01) during the relevant period. Provide the service description, quantity treated, ex-VAT service value, dates, the other contracting party and its contact details, and the procurement reference number where applicable.
- Lot 2, bio-waste: at least one contract involving the biological treatment of a total of at least 200 tonnes of biodegradable kitchen and canteen waste (20 01 08) and/or biodegradable garden and park waste (20 02 01). Treatment must include biological processing, such as composting or anaerobic digestion. Provide the waste codes and quantities treated, ex-VAT service value, dates, the other contracting party and its contact details, and the procurement reference number where applicable.
- Lot 3, bulky waste: at least one contract involving the treatment of at least 30 tonnes of bulky waste (20 03 07), including sorting, preparation for reuse, recovery or disposal. Provide the quantity treated, ex-VAT service value, dates, the other contracting party and its contact details, and the procurement reference number where applicable.
The offer must comply with the tender documents and must not be conditional. For any joint bid, appoint an authorised representative and provide the joint bidders’ power of attorney. Identify any claimed trade secrets and explain the basis; the offer price and other specified evaluation-related figures may not be classified as trade secrets. Where equivalence is relied upon, explain it and provide supporting evidence.
For each lot, submit the required treatment-site information for the main and substitute receiving sites and any intermediate storage and final treatment sites. Include each site’s name and address, operator, environmental permit number, permitted waste codes and operations, and permitted annual capacity. The proposed sites and operations must be authorised and have sufficient permitted and actual capacity. Submit a description of the treatment technology and process, including the sites, planned recovery or disposal operation codes, main process stages, expected outputs and the estimated proportions assigned to each treatment route, with the basis and explanation for those estimates. For Lot 1, describe the proportions recycled, incinerated and landfilled, as well as any other outputs or routes. For Lot 2, explain how the required recycling and end-of-waste criteria and the separation and appropriate treatment of impurities will be ensured; provide the required evidence or a document proving that certification has been initiated, together with the completion schedule and required confirmation. For Lot 3, explain how items suitable for preparation for reuse and materials suitable for recycling will be separated and how the remaining waste will be treated.
