Compliance requirements

The bidder must confirm that no mandatory exclusion ground applies. The contracting authority will exclude a bidder where the bidder, or a person authorised to represent, make decisions for or control it, has been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences or related conduct, money laundering or terrorist financing; offences involving the employment of a foreign national without legal grounds or breaches of the conditions for employing foreign nationals in Estonia, including paying below the statutory minimum; or unlawful child labour or human trafficking. Exclusion also applies where the bidder has outstanding state tax, social security contribution or environmental charge debts under the applicable rules, or where the bidder or a member of its administrative, management or supervisory body is subject to an international sanction, unless awarding the contract would not breach that sanction. The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; bankruptcy, liquidation, suspended business activity or a similar situation; serious professional misconduct; arrangements or coordinated conduct that distort competition; an unmanageable conflict of interest; an unfair competitive advantage arising from involvement in preparing the procurement; serious or persistent failures under earlier public contracts resulting in termination, withdrawal, a price reduction, compensation or a penalty; false or omitted information about qualification, including failure to provide requested supporting documents; attempts to improperly influence the contracting authority, negligent misleading statements affecting its decisions, or attempts to obtain confidential information for an unfair advantage; convictions for tax offences involving the bidder or relevant representatives; or lack of a legal right to submit a bid or application.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 300,000 in each of the last three completed financial years. The bidder must provide extracts from its annual reports showing turnover, unless the information for an Estonian-registered legal entity is publicly available to the contracting authority. If the financial year does not coincide with the calendar year, the requirement applies to the three most recently completed financial years. At the bid submission date, at least six months must have passed since the end of the most recently completed financial year. During the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of this procurement; at least one must have a value of EUR 150,000 or more excluding VAT. The bidder must submit a list stating the performance period, the other contracting parties’ details (including the customer representative’s telephone number and email address) and, for public contracts, the reference numbers. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost. The completed form for previous electrical construction contracts and, where required, written confirmations from the other contracting parties must be submitted. The bidder must have a worker with valid switching authorisations for work-related switching in the 0.22–20 kV electricity network, including operational switching, isolation and earthing, re-energisation and restoration of the normal configuration, except at regional and distribution substations. This worker must be registered in Elektrilevi’s Partner Portal before bids are opened; the authorisations must follow procedure J387. The bidder must also have a person designated as responsible for the work operation, registered in the portal before bids are opened, in accordance with documents J31 and J3284. The person directing electrical work must hold valid A-class competence and/or a qualification of at least level 6 under the Occupational Qualifications Act, have proof of that qualification and be registered in the portal before bids are opened. The bid must accept the tender documents without additions or conditions and include the prescribed price table, with every unit-price field completed. The bidder must identify any information claimed as a trade secret and explain why it qualifies; the price and other specified evaluation-related figures or indicators may not be designated as trade secrets. The bidder must provide the name, position and contact details of the contract signatory or signatories, evidence of their authority to represent the bidder, and the name, position and contact details of the contract-performance contact person. A power of attorney must be included if signing authority does not arise from the articles of association. The bidder’s place of residence or establishment must not be in the Russian Federation or Belarus. Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from either country; the contracting authority may request certificates of origin. Standard payment periods from receipt of the invoice are 14 calendar days for contracts up to EUR 59,999, 35 calendar days for contracts from EUR 60,000 to EUR 249,999, and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. The provided document does not specify award criteria.
