Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded for relevant final convictions of the bidder or its representatives for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements, a similar legal situation, appointment of an administrator or suspension of business; serious professional misconduct; agreements with other businesses intended to distort competition; an unresolved conflict of interest or an unfair advantage arising from involvement in preparing the procurement; and serious or repeated breaches of earlier contracts resulting in early termination, damages or comparable sanctions. Exclusion may also apply for breaches of environmental, social or labour-law obligations; enabling a foreign national to work unlawfully; tax offences; local tax arrears where applicable; or a contract that would breach international or national sanctions. Grounds also include submitting false or misleading information, withholding required information, failing to provide requested supporting documents, or improperly seeking confidential information or influencing the contracting authority’s decisions. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder’s net turnover for the last three financial years completed by the start of the procurement must total at least EUR 3,000,000, excluding VAT. The bidder must also have properly performed at least three contracts during the 36 months before the procurement began, each worth at least EUR 100,000 excluding VAT, involving the sale of document scanners and related software licences and the provision of product support. The bidder must list these contracts, including their dates, a description of the subject matter and the client’s contact details; the contracting authority will verify compliance for the successful bidder and may contact the clients. The bidder must have the manufacturer’s authorisation to sell the equipment and provide product support in Estonia. This must be evidenced by a document or a reference to the manufacturer’s website. If authorisation is established through a partner, evidence is required both of the manufacturer’s authorisation of that partner and of the partner’s cooperation with the bidder. The offered equipment must be certified to BSI TR-03105 Version 2.0, Parts 5.1 and 5.2. The bidder must provide the equipment names, technical descriptions and relevant certification evidence. The equipment must include a software module enabling integration with Secunet Biomiddle version 3.2.x, supported by confirmation from the manufacturer or Secunet Security Networks AG. The bidder must submit the completed technical description and a list, with dates, of database updates for document models made during the two years before the procurement began. Only bidders established in Estonia, another EU Member State, an EEA contracting state or a country party to the WTO Government Procurement Agreement may participate; this also applies to joint bidders and subcontractors. The offer must comply with the procurement documents, be unconditional, follow the required price-submission structure and remain valid for four months. The bidder must provide the information and documents specified in the compliance requirements, including contract-signatory and performance contact details. Joint bidders must include an authorisation appointing their representative. The bidder must also confirm compliance with the applicable international sanctions requirements concerning the contract, goods, subcontractors and suppliers. Any claimed equivalence must be explained and supported by evidence.
