Compliance requirements
A bidder must be excluded if the bidder, or a person authorised to represent, manage, control or make decisions for it, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; unlawful employment of a foreign national or violations of conditions for their employment in Estonia, including payment below the statutory wage rate; or unlawful child labour or trafficking-related offences. Exclusion is also required where the bidder has tax, duty or environmental-charge arrears under Estonian law, or tax or social-security contribution arrears under the law of its country of establishment, or where awarding the contract would breach an international or Estonian government sanction.
The contracting authority may also exclude a bidder for a significant or persistent breach of an essential term of a previous public contract that resulted in termination, withdrawal, a price reduction, compensation or a contractual penalty, or for providing false information or failing to provide information or additional documents requested in relation to exclusion grounds or qualification requirements.
The bidder must submit the declarations on the absence of exclusion grounds using Annex 5. Each member of a joint bid must provide the relevant declarations.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register of an EU or EEA member state, or a country that is a party (not merely an observer) to the WTO Government Procurement Agreement, where registration is required by the law of the bidder’s country of establishment. A valid registration certificate must be provided on request; bidders registered in Estonia do not need to submit a copy.
For each of the three financial years 2023, 2024 and 2025, the bidder’s net turnover from sales of electrical goods must have been at least EUR 200,000 excluding VAT. If the bidder’s financial year does not run from 1 January to 31 December, turnover for its corresponding financial years must be stated. Turnover data must be provided using Annex 5; supporting annual-report extracts or other evidence must be submitted on request, unless the information is publicly available to the contracting authority in Estonia’s business register.
If the bidder relies on another entity’s resources to meet financial or technical and professional capacity requirements, it must identify that entity in Annex 5 and provide that entity’s declarations using Annex 5.1.
The bid must accept all tender-document conditions; conditional bids are not permitted. The bidder must submit the participation declaration in Annex 2 and state the discount offered from the current retail price list. The offered discount will be binding throughout the framework agreement. The bidder must have sales offices in Tallinn and Tartu and provide their addresses and contact details. The number of offices will be taken into account in the evaluation, but the available document does not specify the scoring method. The bidder must have a website with information about the products and confirm that products can also be ordered by email.
Joint bidders must appoint an authorised representative using Annex 4, with the authorisation signed by all joint bidders, and confirm joint and several liability. The bid must identify any trade secrets and explain why the information qualifies, or state that it contains no trade secrets. The bid must comply with the tender documents; where equivalence is relied on, it must be explained and supported by evidence.
