Compliance requirements
The bidder is excluded if the bidder, or a member of its administrative, management or supervisory body or another person authorised to represent, decide for or control it, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorist offences, money laundering or terrorist financing; enabling the unlawful employment of a foreign national or breaches of the conditions for employing foreign nationals in Estonia, including paying less than the statutory wage; or unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding public tax, duty or environmental charge liabilities, or tax or social security contribution debts under the law of its country of establishment, or where awarding the contract would breach an international or Estonian government sanction.
Participation is limited to businesses established in Estonia, another EU Member State, an EEA contracting state or a country party to the WTO Government Procurement Agreement. Businesses established in Russia or Belarus may not participate. The bidder must confirm that these grounds do not apply and that its place of establishment is not in Russia or Belarus. The offered goods must not be subject to international sanctions or originate in a sanctioned region. The bidder must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers that are Russian citizens, residents or entities established in Russia; entities more than 50% directly or indirectly owned by such persons or entities; or representatives or persons acting on their instructions.
