Compliance requirements
The bidder must declare whether any exclusion grounds apply to it or to relevant members of its management, supervisory bodies or representatives. Grounds include final convictions within the previous five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include breaches of tax or social security payment obligations; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activity; serious professional misconduct; agreements intended to distort competition; unmanageable conflicts of interest; involvement in preparing the procurement where this gives an unfair advantage; early termination of previous contracts or comparable sanctions; and false or misleading information, withholding required information or documents, or improperly seeking confidential information.
The grounds also cover breaches of environmental, social or labour-law obligations. National grounds include enabling a foreign national to work without a lawful basis or in breach of employment conditions (mandatory exclusion ground), being subject to international sanctions that would make the contract unlawful, and convictions for tax offences (voluntary exclusion ground). Tax and social security debts are assessed under the applicable national rules; in Estonia, a tax debt below EUR 100 or a debt whose payment has been deferred does not prevent issuance of a tax-debt certificate. Where permitted, the bidder may provide evidence of measures taken to restore its reliability; this possibility applies to procurements above the international threshold or where the tender documents provide for it.
Qualification criteria and exclusion grounds
The ESPD does not set specific selection thresholds such as turnover or experience requirements. The bidder must submit the participation declaration in Form 1 and confirm that the tender complies with the procurement documents; conditional tenders are not permitted. If the signatory’s authority is not evident from the register, a power of attorney using Form 2 must be provided. Joint bidders must appoint an authorised representative from among themselves and submit their joint-bid power of attorney. The bidder must submit a price offer using Form 4.
Products must comply with the technical specification. The bidder must provide product descriptions, manufacturer information, instructions, certificates, declarations of conformity or other relevant evidence needed to assess compliance. Equivalent solutions may be offered instead of referenced standards, labels or other specifications; equivalence must be explained and evidenced where necessary.
For copy paper, provide an EU Ecolabel or equivalent EN ISO 14024 Type I ecolabel certificate. If the paper has no ecolabel, provide an audit by a conformity assessment body or independent auditor confirming compliance with the relevant ecolabel criteria. The lawful origin of the primary wood fibre used in the paper must be confirmed; evidence of origin is due upon delivery. For uncertified fibre, specify the fibre types, quantities and origins, confirm their legality, and ensure traceability from forest to finished product. Provide the paper manufacturer’s details and a certificate for ISO 9001, ISO 14001 or EMAS, or an audit confirming that an equivalent management system meets the relevant criteria.
For work chairs, declare REACH Candidate List substances present above 0.1% by weight in the product, its components or materials, and provide evidence upon delivery of their presence or absence. Furniture must be dismantleable with hand tools and its parts replaceable by an untrained person; provide instructions enabling damage-free dismantling and repair. The warranty must last at least 2 years from delivery, cover repairs and provide a replacement product during warranty repairs at no extra charge; the buyer may require a longer warranty. Spare parts or functionally equivalent components must remain available for at least 2 years after delivery. As recommended supplementary information, provide a list of furniture packaging materials and explain their recyclability, use of renewable materials or reusability, and ease of manual sorting.
The bidder must identify information claimed as a trade secret and justify that designation; the tender price and figures used for evaluation may not be classified as trade secrets. The tender conditions do not specify the award criteria.
