Compliance requirements
The exclusion grounds include final convictions within the previous five years, or a continuing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. They also cover breaches of tax or social security payment obligations; environmental, social or labour law obligations; bankruptcy, insolvency, liquidation, creditor arrangements, administration of assets by a liquidator or court, suspended business activity, and comparable situations under national law; serious professional misconduct; agreements intended to distort competition; conflicts of interest that cannot be avoided by other means; and involvement in preparing the procurement where an resulting competitive advantage cannot otherwise be prevented. Further grounds include significant or repeated breaches of previous contracts resulting in termination, price reduction, damages or penalties, false or misleading information, withholding information or required documents, improper attempts to influence the contracting authority or obtain confidential information, enabling the unlawful employment of a foreign national, being subject to applicable international sanctions, and convictions for tax offences. The bidder may, where permitted, submit evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
For both lots, the bidder must be registered in the commercial register or the corresponding register in its country of establishment. The bidder must also hold a valid environmental permit for the service and provide the permit number and validity period.
For each lot, the bidder must have liability insurance of at least EUR 30,000 covering potential damage arising from the waste transport and treatment service, or provide other evidence acceptable to the contracting authority showing that the necessary compensation funds are available or can be obtained. Evidence of insurance or alternative financial means must be provided at the contracting authority’s request.
The bid must follow the required pricing structure, and conditional bids are not permitted. The bidder must confirm compliance with the procurement documents and explain, with supporting evidence where necessary, how any proposed equivalent meets the requirements. The bid must describe the intended treatment method for each waste type, prioritising preparation for reuse and recycling over other recovery, including energy recovery, and disposal, while taking account of the waste’s characteristics, technical feasibility, economic viability and environmental impact. The bidder must also submit Appendix 3 with details of the proposed treatment and temporary storage locations. Where a joint bid is submitted, the joint bidders must appoint an authorised representative and include the relevant power of attorney.
