Compliance requirements
The bidder must disclose whether it or its representatives have relevant final convictions within the previous five years, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also cover unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, similar proceedings, creditor arrangements, administration of assets by a liquidator or court, or suspended business activity; serious professional misconduct; agreements that distort competition; conflicts of interest that cannot otherwise be avoided; involvement in preparing this procurement that creates an advantage that cannot otherwise be remedied; and significant or repeated breaches of previous public contracts resulting in termination, damages, price reductions or penalties.
Other grounds include false or misleading information, failure to provide required information or documents, attempts to obtain confidential information or improperly influence the procurement, enabling the employment of a foreign national staying unlawfully or breaching the conditions for employing a foreign national in Estonia, entering into a contract in breach of an international or Estonian government sanction, and relevant tax-crime convictions. Some grounds are mandatory and others discretionary under Estonian law. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
