Compliance requirements
A bidder may be excluded for final convictions within the previous five years, or while an exclusion period remains in force, involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, suspended business activity or a comparable situation; serious professional misconduct; agreements intended to distort competition; an unresolvable conflict of interest; involvement in preparing the procurement that creates an advantage that cannot otherwise be eliminated; and significant or repeated failures under earlier contracts resulting in termination, damages, price reduction or penalties. Exclusion may also follow from false or misleading information, failure to provide required information or documents, or attempts to improperly influence the procurement or obtain confidential information. Environmental, social or labour-law breaches may also be grounds for exclusion.
National grounds include enabling the unlawful employment of a foreign national, being subject to an international sanction that would make the contract unlawful, and, as a discretionary ground, conviction for tax offences. The notice sets the tax and social-contribution debt threshold at EUR 0; under the stated national rules, a certificate is not issued for debt below EUR 100 or where payment has been rescheduled. Where permitted for this procurement, a bidder may provide evidence of measures taken to restore its reliability.
