Compliance requirements

The bidder may be excluded for relevant final convictions within the previous five years involving the bidder or its representatives, management or supervisory members, including corruption, fraud, terrorism-related offences, money laundering, terrorist financing, participation in a criminal organisation, child labour or human trafficking. Exclusion may also apply for convictions involving unlawful employment of a foreign national or tax offences, and for being subject to applicable international sanctions. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an analogous procedure, creditor arrangements, administration of assets by a liquidator or court, or suspended business activity; serious professional misconduct; agreements or conduct intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an advantage which cannot otherwise be neutralised; and significant or persistent breaches of an earlier public contract resulting in early termination, damages, price reduction or penalties. Where legally available, the bidder may provide evidence of remedial measures demonstrating restored reliability.
