Compliance requirements
The exclusion grounds include final convictions within the previous five years, or an exclusion period still in force, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Grounds also cover unpaid taxes or social security contributions; insolvency, bankruptcy, liquidation, creditor arrangements, court or liquidator administration of assets, or suspended business activity; serious professional misconduct; competition-distorting agreements; conflicts of interest that cannot be avoided by other means; involvement in preparing the procurement that creates an unavoidable competitive advantage; serious or repeated breach of an earlier public contract resulting in early termination, damages, a price reduction or a penalty; and false or misleading information, withholding information or failure to submit requested supporting documents. National grounds include enabling a foreign national to work without legal grounds, being subject to applicable international sanctions, tax offences, and restrictions on participation based on the bidder’s country of establishment. The bidder may be asked to provide details and, where permitted, evidence of measures taken to restore its reliability. The grounds apply to all lots.
