Compliance requirements
The bidder must not be subject to the exclusion grounds set out in Estonian Public Procurement Act § 95(1), points 1–5, or § 95(4), point 12, and must confirm their absence. If the bidder or a participating entity has persons authorised to represent, control or make decisions for it who are not identifiable from the Estonian commercial register, provide each person’s name and personal identification code, or confirm that there are no such persons. For a foreign bidder or a foreign entity participating in the bid, submit evidence that the specified exclusion grounds do not apply to the entity and its administrative, management or supervisory body members, authorised representatives and other persons entitled to represent or control it or make decisions on its behalf. For a foreign company’s branch, provide the evidence for the foreign company.
Qualification criteria and exclusion grounds
The bidder must have completed at least one contract during the 36 months preceding the deadline for publication of the contract notice in the Estonian Public Procurement Register. The contract must have involved owner’s supervision of building construction works and have been worth at least EUR 55,000 excluding VAT. The supervised building must have heating, ventilation, cooling and their automation for indoor climate control, at least two storeys, a net area of at least 2,000 m², and an occupancy permit. Only the portion performed during the 36-month reference period counts; the requirement is also met if the warranty period for the construction contract has not ended by the bid deadline. Submit the contract details using Appendix 3, including a short description, value, performance period, the other contracting party’s representative and contact details, and, where applicable, the procurement reference number.
The contract must be performed by four responsible specialists, or persons with equivalent qualifications: an owner’s supervision specialist for building water supply and sewage, with at least Level 7 certified engineer qualification in that specialisation and the owner’s supervision work component; an owner’s supervision specialist for heating, ventilation and cooling, with at least Level 7 certified engineer qualification and the owner’s supervision work component; a low-voltage systems owner’s supervision specialist with at least Level 6 security systems designer qualification covering alarm systems and fire alarm systems design; and an automation owner’s supervision specialist with at least Level 7 certified electrical engineer qualification specialising in building electrical installations. Provide each specialist’s details, including name, personal identification code, education and/or professional qualification, using Appendix 4. Qualification documents must be submitted for specialists whose qualifications were obtained outside Estonia; Estonian qualifications are checked by the contracting authority.
A bidder relying on another entity’s capacity must provide that entity’s signed consent using Appendix 5, confirming the capacity being relied on and its direct participation in performance to at least the extent of that reliance. The entity must be added as a subcontractor and the reliance declared. Where joint bidders rely on one another’s resources, provide Appendix 6 with each party’s share and the nature of its work. Joint bidders must also appoint an authorised representative and provide the joint-bid authorisation using Appendix 6.
The bid must accept the procurement-document conditions, be unconditional, and be signed by the bidder’s legal representative or an authorised person; attach a power of attorney where applicable. Submit the price in the required structure. Any proposed equivalent must be explained and supported by evidence. Identify and justify any information claimed as a trade secret; the bid price and evaluation-related figures may not be designated as trade secrets. No award criteria are specified in the supplied documents.
