Compliance requirements

The bidder confirms that neither it nor its representatives or members of its management or supervisory bodies have, in the last five years, been finally convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering or terrorist financing, unlawful use of child labour, or human trafficking. Grounds for exclusion also include unpaid taxes or social security contributions; bankruptcy, liquidation or a similar insolvency situation; assets being administered by a liquidator or court; serious professional misconduct; and a material or repeated breach of a previous public contract that resulted in termination, compensation, a price reduction or a contractual penalty. A further ground for exclusion is enabling a foreign national residing in the country without legal grounds to work, or enabling a breach of the conditions for a foreign national’s employment in Estonia, including payment below the statutory wage rate. The authority will also check that awarding the contract would not breach international or Estonian sanctions and that the bidder is entitled to participate under the tender documents. The stated threshold for unpaid tax or social security contributions is EUR 0; however, the tax authority does not issue a tax-debt certificate when the debt is below EUR 100 or its payment has been deferred. Where applicable, the bidder may provide information on settling the debt or entering into a binding payment arrangement.

Qualification criteria and exclusion grounds

The bidder’s net turnover in its most recently completed financial year before the procurement began must be at least EUR 50,000. Joint bidders may add their turnover figures together. At the contracting authority’s request, turnover must be evidenced by an extract from the annual report or another document if the information is not publicly available to the authority. If relying on another entity’s turnover, the bidder must provide that entity’s ESPD and, when requested, its undertaking to provide financial resources and accept joint and several liability for the relevant part of the contract. During the 60 months preceding the start of the procurement, the bidder must have properly completed at least one contract involving the installation on public roads of at least 50 traffic signs, including signposts, and at least 50 units of safety barriers. At the authority’s request, the bidder must provide the client’s confirmation of the works, the contract completion period and the installed structures. If relying on another entity’s technical capacity, the bidder must provide its ESPD and, when requested, its undertaking to participate directly in performing the contract at least to the extent for which its capacity is relied upon. The bid must include a fully completed cost schedule in Excel format. Prices must be entered for every payment item; the authority’s listed items, descriptions, parameters, units, quantities and other specified data must not be changed or deleted. Prices must be stated in euros to two decimal places. The bidder must confirm acceptance of the contract notice and tender-document conditions and that its bid covers all matters for which the authority requested competing bids. For a joint bid, the bidders must submit a signed power of attorney appointing their representative and a separate ESPD for each joint bidder. For exclusion checks, the bidder must provide the names and personal identification codes of authorised representatives of the bidder, joint bidder, relied-upon entity or foreign-company branch who are not identifiable from registry records, or confirm that there are no such persons. The bid must identify and justify any information claimed as a trade secret; the bid price and figures reflecting the award criteria may not be designated as trade secrets.
