Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant convictions of the bidder or its managers, representatives or persons exercising control for organised crime, corruption, fraud, terrorism-related offences, money laundering, unlawful employment or exploitation of foreign workers, illegal child labour or human trafficking; outstanding tax, social security or environmental levy debts; and being subject to international sanctions, except where awarding the contract would not breach those sanctions. The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; insolvency, liquidation or suspension of business; serious professional misconduct; anti-competitive agreements or conduct; an unmanageable conflict of interest; an unfair competitive advantage arising from involvement in preparing the procurement; serious or repeated failure to perform a previous public contract; false or misleading information or failure to provide requested evidence; attempts to improperly influence the contracting authority or obtain confidential information; convictions for tax offences; or lack of the legal right to submit a bid. The bidder must confirm that these discretionary grounds do not apply. Businesses established in Russia or Belarus are not permitted to participate.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 100,000 in each of the last three completed financial years. The bidder must provide extracts from the financial statements for those years showing net turnover, unless the information is publicly available to the contracting authority in a register. If the bidder’s financial year does not follow the calendar year, the requirement applies to its three most recently completed financial years. At least six months must have elapsed since the end of the most recently completed financial year by the bid submission date. During the 60 months preceding the start of the procurement, the bidder must have duly completed at least three contracts for electrical construction works similar to the contract subject matter. At least one contract must have been worth EUR 80,000 or more, excluding VAT. The bidder must submit a list stating the performance period, the other contracting party’s details, including a contact person’s telephone number and email address, and procurement reference numbers where applicable. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from databases without significant expense. The bidder must have a worker with valid switching authorisations for work-related switching in the 0.22–20 kV electricity network, including operational switching, isolation and earthing, re-energising and restoration of the normal network configuration, excluding regional and distribution substations. This person must be registered in Elektrilevi’s Partner Portal before bids are opened. The bidder must also have a person designated as responsible for the work operation, registered in the portal before bids are opened. The bidder must have a person leading electrical works who holds valid A-level competence and/or a qualification of at least level 6 under the Vocational Qualifications Act, has evidence of that qualification as of the bid submission date, and is registered in the portal before bids are opened. The bid must comply with the procurement documents, include the completed price table in the prescribed form with every unit-price field filled in, and may not contain additional or conditional terms. The bidder must provide the contract signatory’s name, position, contact details and evidence of authority to represent it, as well as a contact person for contract performance. A power of attorney must be included if the signatory’s authority does not arise from the articles of association. Materials, equipment, goods and components installed or used in the works must not originate from or be produced in Russia or Belarus; the contracting authority may request certificates of origin.
