Compliance requirements
The bidder must confirm that none of the exclusion grounds under section 95(1), points 1–3 and 5, of the Estonian Public Procurement Act applies, taking account of section 95(2). The bidder must also confirm that it is not bankrupt, being wound up, subject to bankruptcy or liquidation proceedings, or in a comparable situation under the law of its country of establishment, and that its business activities have not been suspended. It must have no outstanding national taxes, duties or environmental charges, or tax or social security contribution debts under the law of its country of establishment.
The bidder must confirm that, during the reference period, its employees’ average pay exceeded 70% of the average pay for the same period in the field corresponding to the contract. The reference period is six calendar months, ending in the calendar month two months before the month in which the procurement procedure began. The bidder must provide an extract from the Estonian Tax and Customs Board; a foreign bidder must provide evidence from an equivalent competent authority in its country of establishment. Each member of a joint bid must provide evidence. The bidder must also confirm that it is not a related party of the technical consultant advising the beneficiary on the apartment building’s reconstruction. The beneficiary checks exclusion grounds for the successful bidder and, in a joint bid, for each member.
Qualification criteria and exclusion grounds
The requirements apply to all parts of the procurement.
- **Registrations:** The bidder must be registered in Estonia’s Register of Economic Activities for construction, covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. If electrical work is carried out, the bidder must also be registered for electrical installation construction, including installation. Foreign bidders may provide equivalent evidence of competence instead of these registrations.
- **Financial capacity:** The bidder’s net turnover in the financial year before the procurement began must be at least twice the estimated contract value excluding VAT. For a bidder whose financial year is the calendar year, the relevant year is 2025. The bidder must also be able to provide a performance security equal to 5% of the contract value by the contract-signing date or within 10 calendar days after signing. An acceptable security may be a guarantee confirmed by a credit or financial institution, or the required amount deposited in the beneficiary’s or a notary’s account, with the beneficiary entitled to it throughout the construction period. Joint bidders may provide the security jointly.
- **Relevant experience:** During the 60 months before the procurement began, the bidder must have completed at least one equivalent construction project worth at least half the estimated contract value excluding VAT. The bidder must have acted as the main contractor on a new-build, extension or whole-building reconstruction project that included construction or reconstruction of the building’s load-bearing structures and external envelope, heat-recovery mechanical ventilation, and a new heating system. Completion must be evidenced by a handover and acceptance certificate signed by the client and contractor, or by the relevant building-register use notice or occupancy permit information. The bidder must provide project details, dates, value, scope and evidence of completion.
- **Project team:** The works must be carried out by named personnel with the required qualifications or equivalent foreign qualifications: a project manager with at least building engineer level 6 qualification in building construction and construction management, or construction manager level 6 in general construction; a site manager with construction work supervisor level 5 qualification in general construction; a ventilation and heating systems specialist with HVAC engineer level 6 qualifications covering management of heating and ventilation construction, or construction manager level 6 in indoor climate systems; and a water supply and sewerage specialist with engineer level 6 qualifications covering construction management, or construction manager level 6 in internal or associated water supply and sewerage systems. For electrical work, the team must include a person with at least a class B electrical competency certificate or electrical engineer level 6 qualification for consumer electrical installations. The team must also include an authorised architect, level 7, responsible for the project’s compliance with the New European Bauhaus requirements. These personnel must take part in carrying out the works; their names and certificate or qualification numbers must be provided.
- **Management systems:** The bidder must have construction-sector quality and environmental management systems meeting at least EVS-EN ISO 9001 and EVS-EN ISO 14001, or equivalent requirements. Certificates may be checked in the relevant Estonian database; if they cannot be verified there, the bidder must provide a valid certificate or other appropriate evidence when requested.
- **Offer compliance and documents:** The bid must accept all tender-document requirements and may not be conditional. The bidder must submit the price using the beneficiary’s form. Where equivalent products, methods or other solutions are proposed, evidence of equivalence must be included. For a joint bid, a power of attorney must specify each member’s share and nature of the contract work; the joint bidders remain jointly and severally liable. The bid must be submitted by a statutory or authorised representative; an authorisation must be attached if required. For external team members who are not the bidder’s employees or registered competent personnel, written consent to participate in the team and contract performance must be provided.
