Compliance requirements

The bidder must declare whether it or its relevant representatives have been convicted within the applicable period of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or offences involving child labour or human trafficking. The contracting authority also checks for unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, court- or liquidator-managed assets or suspended business; serious professional misconduct; agreements intended to distort competition; conflicts of interest or involvement in preparing this procurement that cannot otherwise be remedied; serious or repeated failures under earlier public contracts; false or misleading information, failure to provide required information or documents, or improper attempts to obtain confidential information. National grounds also cover enabling unlawful employment of a foreign national, being subject to applicable international sanctions, tax-related offences and any restriction on the bidder’s right to participate based on its place of establishment. The bidder may be asked to provide further information or evidence. Where permitted, it may submit evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder’s net turnover in the last financial year completed by the start of the procurement must be at least EUR 100,000. Joint bidders may add their turnover figures together. The contracting authority may request the annual report extract or other evidence of turnover; it recommends submitting this with the tender if the information is not publicly available in the Estonian Commercial Register. If relying on another entity’s turnover, provide the required information and, when requested, that entity’s consent and evidence of its turnover. The supporting entity is jointly liable with the bidder for the part of the contract for which its capacity is used. The bidder must have properly completed at least one contract for the design of a publicly used road construction project during the 36 months preceding the start of the procurement. The contract must have a value of at least EUR 75,000 excluding VAT. The contracting authority may request confirmation from the client that the contract was properly performed and resulted in a road construction project, together with the completion period and contract value excluding VAT. If relying on another entity’s technical or professional capacity, submit the required information and, when requested, its consent; that entity must participate directly in performing the contract at least to the extent of the capacity relied upon. The tender must include the completed work-part handover and payment schedule in the prescribed Excel file. Enter all work-part prices in euros to two decimal places and do not alter the file beyond what is needed to complete it. The bidder must confirm acceptance of all tender conditions and that its tender covers only the matters for which competing tenders were requested. If submitting a joint tender, provide a signed authorisation naming the representative and separate ESPDs for all joint bidders. Identify any authorised representatives not visible in the relevant business-register extract, with their names and personal identification codes, or confirm that there are none.
