Compliance requirements

The bidder must declare whether it, or any person in its management, administrative or supervisory bodies or authorised to represent, decide for or control it, has a relevant final conviction within the previous five years or remains subject to an exclusion period. Grounds include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking offences. The bidder must also declare whether it has unpaid taxes or social security contributions; the notice specifies a zero threshold, while Estonian tax-debt certificates are not issued for debt below EUR 100 or where payment has been rescheduled. Other grounds include breaches of environmental, social or labour obligations; bankruptcy, insolvency or liquidation proceedings, an arrangement with creditors, comparable national proceedings, assets administered by a liquidator or court, or suspended business activity; serious professional misconduct; anti-competitive agreements; conflicts of interest; involvement in preparing the procurement; early termination or sanctions under a previous contract; false or misleading statements, withheld information, failure to provide requested evidence, or improper attempts to influence the procedure or obtain confidential information. The bidder must also confirm that contracting with it would not breach international sanctions and that it has not been convicted of enabling a foreign national to work without legal grounds or in breach of Estonian employment conditions. Where a ground applies, the bidder may provide information on measures taken to restore its reliability if the applicable rules allow this. First-tier subcontractors are checked for the stated criminal, tax and social-security exclusion grounds; the bidder also confirms it will not use a subcontractor subject to mandatory replacement under the applicable rules.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least 2 similar construction contracts during the 60 months preceding the start of the procurement. Each reference contract must have involved construction of a building with a building footprint of at least 100 m², and each building must have been issued a use permit upon completion. The bidder must provide details of the contracts in the European Single Procurement Document; at the contracting authority’s request, it must provide a certificate from each client confirming proper performance. If relying on another entity’s capacity, the bidder must submit that entity’s European Single Procurement Document and demonstrate that the resources will be available for contract performance. Throughout the contract period, the bidder must engage: - a project manager with at least Construction Manager, level 6, specialising in general construction, or an equivalent or higher qualification; - a designer with at least Construction Engineer, level 6, in general construction, specialising in design management, or an equivalent or higher qualification; - an electrical engineer with at least Electrical Engineer, level 6, or an equivalent or higher qualification, and valid competence required to design and construct the electrical installation covered by the procurement. Qualifications equivalent to the Estonian requirements must be supported by evidence of equivalent or higher competence. For personnel whose qualifications or certificates were not issued in Estonia, provide a copy of the relevant licence or professional certificate issued in their country of residence, or other evidence that they are legally entitled to perform the work there.
