Compliance requirements
The bidder must declare whether it or its representatives have relevant convictions within the past five years, including for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation or suspended business; serious professional misconduct; anti-competitive agreements; conflicts of interest or involvement in preparing the procurement; serious breaches of previous contracts; false or misleading information, failure to provide requested information or documents, and attempts to obtain confidential information improperly. National grounds also cover enabling the unlawful employment of foreign nationals, international sanctions, tax offences and restrictions on an operator’s eligibility to participate. The bidder must also provide the requested information about authorised representatives not identifiable from the relevant register. Where an exclusion ground applies, evidence of measures taken to restore reliability may be submitted where permitted.
Qualification criteria and exclusion grounds
The bidder’s net turnover in the last financial year completed by the start of the procurement must be at least EUR 450,000. Joint bidders may aggregate their turnover. If relying on another entity’s turnover, the bidder must identify that entity in the ESPD and, on request, provide its ESPD, the required commitment and evidence of turnover; that entity must accept joint liability for the part of the contract supported by its resources. Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least one contract for construction works on a public road that included laying at least 15,000 m² of the upper asphalt-concrete layer. The bidder must list the relevant contract in the ESPD and, on request, provide the client’s confirmation of the road works, completion period, surface area and proper performance. If relying on another entity’s technical capacity, the bidder must identify it in the ESPD, provide its ESPD and, on request, its commitment; that entity must take part directly in performing the relevant work. The offer must include the completed cost schedule in the prescribed Excel format, with all item prices entered in euros to two decimal places and without altering the supplied entries. Joint bidders must provide a signed authorisation appointing their representative and a separate ESPD for each joint bidder.
