Compliance requirements
A bidder may be excluded if it or a person authorised to represent, manage, or control it has, within the relevant period, a final conviction for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour or human trafficking. Other grounds include breaches of tax or social security payment obligations; bankruptcy, insolvency, liquidation, suspended business activity or comparable proceedings; serious professional misconduct; agreements or conduct distorting competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unpreventable competitive advantage; serious or repeated breaches of earlier contracts resulting in early termination, damages or comparable sanctions; false or withheld information, failure to provide requested supporting documents, or improper attempts to influence the procedure or obtain confidential information; and breaches of environmental, social or labour obligations. National grounds also cover enabling unlawful employment of foreign nationals, being subject to international sanctions, tax-related convictions, and restrictions on the bidder’s right to participate based on its place of establishment. Where the law and procurement documents allow, the bidder may present evidence of measures taken to restore its reliability.
