Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant convictions of the bidder or its representatives for participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorist offences or related conduct, money laundering or terrorist financing, enabling unlawful employment of a foreign national or breaches of the conditions for employing foreign nationals in Estonia, including paying below the statutory wage rate, and unlawful use of child labour or human trafficking. A bidder may also be excluded for outstanding taxes, charges or environmental fees, or unpaid taxes or social security contributions under the law of its country of establishment. International sanctions may also bar participation, except where awarding the contract would not breach the applicable sanction. The contracting authority may also exclude a bidder for a serious or persistent breach of a previous public contract that resulted in termination, withdrawal, a price reduction, compensation for damage or a contractual penalty, or for providing false information about compliance with qualification requirements or failing to provide requested information or additional documents. The bidder must confirm that these grounds do not apply.

Qualification criteria and exclusion grounds

The requirements apply to all lots. - The bidder’s net turnover must have been at least EUR 400,000 in each of the three most recent completed financial years. The bidder must provide extracts from the financial statements for those years showing net turnover, unless the information is publicly available to the contracting authority from a register for a bidder registered in Estonia. If the bidder’s financial year does not coincide with the calendar year, the requirement applies to its three most recent completed financial years. At least six months must have elapsed since the end of the most recent completed financial year by the bid submission date. - During the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for general construction works similar to the contract subject. At least one contract must have had a value of EUR 200,000 or more excluding VAT. The bidder must submit a list stating the performance period, information about the other contracting parties (including the customer representative’s telephone number and email address) and, for public contracts, the reference number. If requested, evidence of proper performance of similar electrical construction contracts must be provided, unless the contracting authority can obtain it from databases without significant cost. The completed form ‘Information on previous contracts’ must be submitted. - The person managing the construction works must be a currently qualified construction engineer or construction manager at level 6, or hold an equivalent qualification of at least level 6 under the Professions Act, and must be registered in the Register of Economic Activities before bids are opened. A copy of the professional certificate must be provided. - The building design must be prepared by a currently qualified chartered construction engineer at level 7 or a general construction designer with an equivalent qualification of at least level 7 under the Professions Act, registered in the Register of Economic Activities before bids are opened. The designer must have experience preparing preliminary and working designs for similar works for Elektrilevi OÜ or Elering AS. The bid must state the work’s name and description, the customer and the period when it was performed; a copy of the professional certificate must also be provided. - The bid must include a price offer in the prescribed table, with every unit-price field completed, and must comply with the procurement documents without additions or conditional terms. The bidder must account for the completion instructions for management system document V178 when preparing the price offer. - The bidder must provide the name, position and contact details of the person(s) authorised to sign the contract, as well as those of the contact person for contract performance. A power of attorney must be included if the signing authority does not arise from the articles of association. - The bidder must identify any information in its bid claimed as a trade secret and explain the basis for that designation. The bid price, component prices and other indicators relevant to evaluation may not be designated as trade secrets. - If subcontractors are used, the bidder must submit the completed form on the use of subcontracting. In a joint bid, the bidders must appoint an authorised representative and provide the required power of attorney. - The bidder must be ready to use Elektrilevi’s partner portal (EPP) to perform the contract. Materials, equipment, goods and components installed or used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. The bidder’s place of residence or establishment must not be in Russia or Belarus. - The standard payment period, counted from the customer’s receipt of the invoice, is 14 calendar days for contracts up to EUR 59,999, 35 calendar days for contracts from EUR 60,000 to EUR 249,999, and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. - No award criterion is specified in the provided documents.
