Compliance requirements
The bidder must confirm that neither it nor its directors, managers, supervisory body members, authorised representatives or controlling persons is subject to exclusion grounds such as final convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or other forms of human trafficking. The bidder must also not have outstanding tax or social security payment obligations, unless the obligations have been settled or a binding payment arrangement has been concluded. Other grounds include bankruptcy, insolvency or liquidation proceedings, an agreement with creditors, suspended business activities, serious professional misconduct, anti-competitive agreements, an unmanageable conflict of interest, involvement in preparing the procurement that creates an unfair advantage, serious or repeated failures under previous public contracts, false or misleading information, failure to submit required information or documents, and breaches of environmental, social or labour-law obligations. The bidder must also confirm compliance with the national exclusion grounds concerning unlawful employment of foreign nationals, international sanctions and convictions for tax offences. Where an exclusion ground applies and the applicable rules allow it, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The procurement concerns a framework agreement for medicines used in chemotherapy, divided into 25 lots; a bidder may submit tenders for up to 25 lots. The bidder must submit the participation application using Annex 3, Form II, and, where several bidders submit a joint tender, appoint an authorised representative and provide the power of attorney and joint-and-several liability confirmation using Annex 3, Form I. For each offered medicine, Annex 1 must be submitted in Excel format and must state the active substance, original name and pack size, unit and strength, pharmaceutical form, pack price, manufacturer, unit price and total price. The offered medicine must have a valid marketing authorisation in Estonia, and the bidder must hold an Estonian wholesale authorisation for medicinal products; these details are confirmed in the participation application and checked by the contracting authority in the relevant registers. The tender must comply with the technical requirements, or any equivalence must be explained and supported by evidence. The price must be submitted in euros, in the required price-form structure, and must include all costs of delivery and unloading at the Tartu University Hospital pharmacy at L. Puusepa 8, Tartu. Unit prices are final and no additional payments or costs will be added. The bidder must confirm that the offered goods are not subject to international sanctions and are not sourced from sanctioned territories. It must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers covered by the specified EU restrictions concerning Russian nationals, residents or entities, or entities owned or controlled by them. The bidder must identify any trade secrets and provide reasons, while the tender price and other price-related evaluation figures may not be classified as trade secrets.
