Compliance requirements
The bidder may be excluded if it or a member of its administrative, management or supervisory body, or a person authorised to represent, make decisions for or control it, has a final conviction within the previous five years, or remains subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or another form of human trafficking. The bidder may be excluded for unpaid taxes or social security contributions in its country of establishment or the contracting authority’s country. Under the stated Estonian tax rules, a tax-debt certificate is not issued where the relevant debt is below EUR 100 or payment has been deferred; foreign bidders are subject to the rules of their country of establishment. Exclusion also applies to the specified domestic grounds: enabling a foreign national to work without a lawful basis or in breach of applicable employment conditions, and being a person subject to an international sanction where awarding the contract would violate that sanction. Where permitted for this procurement, a bidder may provide evidence of remedial measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder, including each member of a joint bid, must be registered in the commercial register or an equivalent register in its country of establishment. A foreign bidder may submit a copy of its registration document with the bid; if it does not, the successful bidder must provide it on request, showing registration as of at least 30 days before the bid deadline. The contracting authority will check Estonian bidders’ registration itself using public records.
During the 36 months before the procurement began, the bidder must have properly completed at least one contract for supplying a snow cannon, another snowmaking device or other technically comparable specialised equipment. The bidder must provide details of the reference contract in the ESPD.
The bid must include a completed technical compliance table identifying the proposed machine’s manufacturer, model and configuration, stating the required technical characteristics and providing references to supporting evidence. The bidder must also submit technical documentation, the manufacturer’s written confirmation or other objectively verifiable evidence of compliance, as well as the manufacturer’s maintenance schedule or a relevant extract showing at least maintenance intervals, scheduled maintenance tasks, and the materials and consumables required. For an equivalent solution, the bidder may provide additional information and evidence of equivalence, but must still submit all information and evidence specifically required by the technical specification. The bid must accept all procurement-document conditions without qualification, and its price must follow the prescribed structure. Joint bidders must appoint an authorised representative and submit the relevant authorisation. Any claimed trade secret must be identified and justified; the bid price and price components cannot be treated as trade secrets.
