Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded for relevant criminal convictions of the bidder or its management or representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, child labour or human trafficking. Grounds also include unpaid taxes or social security contributions, bankruptcy or insolvency, liquidation, suspended business activity, serious professional misconduct, competition-distorting agreements, unmanageable conflicts of interest, involvement in preparing the procurement that creates an unavoidable competitive advantage, serious or repeated breaches of earlier contracts, false or misleading information, failure to provide required information or documents, and attempts to obtain confidential information improperly. Environmental, social and labour-law violations may also be grounds for exclusion. National grounds include enabling unlawful employment of foreign nationals, contracting in breach of international or Estonian sanctions, tax-related criminal convictions, and any applicable restriction based on the bidder’s place of establishment. The notice describes the tax-debt threshold as zero; under the stated national rules, a tax-debt certificate is not issued where the debt is below EUR 100, excluding interest not established by an administrative act, or where payment has been rescheduled. Where legally permitted, a bidder may provide evidence of remedial measures to restore its reliability.

Qualification criteria and exclusion grounds

The bidder and each member of a joint bid must be entered in the business register of their country of establishment where registration is required. Submit a copy of a valid registration certificate or, if registration is not required, a copy of the founding agreement or an equivalent document. During the 36 months preceding the start of the procurement, the bidder must have duly performed at least one contract, or several contracts, for the sale of reagents used on an immunology analyser, with a combined value of at least EUR 100,000. The ESPD must include a list of the contracts, their values and completion dates, and the details of the other contracting parties. Tender document Annex 3, Form IV may also be used where necessary. The bid must include the declaration in Annex 3, Form I and remain valid for at least 3 months from the bid submission deadline. Joint bidders must appoint an authorised representative and submit the original power of attorney. If the person signing the bid is not shown in the register as authorised to represent the bidder, a power of attorney must be included. The bid must comply with the procurement documents and include the technical and price information in the format of Annex 1 for the reagents and accessories used for all specified analyses on the VirClia Lotus analyser. Submit the reagent manufacturer’s information material, a price list for all reagents used on the analyser, and the total bid price. The price must include all delivery costs to Pärnu Hospital’s laboratory at Ristiku 1, 80010 Pärnu. Price information must follow the structure provided on the award-criteria sheet and match Annex 1; conditional bids are not permitted. All offered products must bear CE and IVD markings, with supporting documents submitted. Provide the manufacturer’s confirmation that the products are suitable for use on the VirClia Lotus analyser, as well as a valid manufacturer-issued document proving that the bidder is an authorised official reseller of the offered products. Where equivalence is relevant, explain it and provide supporting evidence. The bidder must confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. Any information designated as a trade secret must be justified in the bid; the bid price and figures relevant to the award criteria may not be classified as trade secrets. The supplied documents do not specify award-criterion scores or weightings.
