Compliance requirements
The procurement passport requires declarations concerning exclusion grounds, including final convictions within the relevant period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. It also covers unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activity; serious professional misconduct; agreements distorting competition; conflicts of interest or involvement in preparing the procurement; serious or repeated breaches of previous contracts; false or withheld information, failure to provide requested evidence, or attempts to obtain confidential information improperly.
National grounds also include enabling unlawful employment of a foreign national, being subject to an international or national sanction, convictions for tax offences, and any restriction on participation based on the bidder’s place of establishment. The bidder must provide the identities and personal identification codes of authorised persons who are not visible to the contracting authority in the Commercial Register, or confirm that no such persons exist. It must also confirm that it will not use a subcontractor who would have to be replaced under the applicable rules. Where a relevant ground exists, evidence of remedial measures may be submitted when permitted for this procurement.
Qualification criteria and exclusion grounds
The bidder’s average annual net turnover for the three completed financial years from 1 January 2023 to 31 December 2025 must be at least EUR 100,000. The bidder must also have completed at least two reference contracts during the 60 months preceding the start of the procurement. Each reference must concern a local government’s development plan for a joint water supply and sewerage system.
The bidder must name a design expert holding the Level 7 water supply and sewerage engineer qualification, specialising in external water supply and sewerage and the preparation of external water supply and sewerage designs, or an equivalent qualification. The bidder must provide the expert’s name and professional certificate number.
The bidder must submit the completed and signed Form 2, “Bidder’s confirmations”, and the completed work-volume schedule (Form_1_1_Töömahuloend), and structure the price submission according to the pricing sheet. Conditional bids are not permitted; submission confirms acceptance of the procurement documents’ requirements. The bidder must confirm that its registered or permanent place of business is in Estonia, another EU Member State, an EEA contracting state, or a country party to the WTO Government Procurement Agreement. It must provide the names and personal identification codes of authorised persons not identifiable to the contracting authority through the Commercial Register, or confirm that there are none.
