Purchase of seating furniture

The bidder must confirm that no exclusion grounds apply. These include relevant criminal convictions of the bidder or its representatives within the past five years, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation or suspended business activity; serious professional misconduct; anti-competitive agreements; unmanageable conflicts of interest or involvement in preparing the procurement; serious failures under previous contracts; false or misleading information, failure to provide requested information or documents, or attempts to obtain confidential information improperly; breaches of environmental, social or labour obligations; unlawful employment of foreign nationals; applicable international sanctions; tax offences; and any restriction on the bidder’s right to participate. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.

The bidder’s total net turnover must have been at least EUR 100,000 in each of the financial years available among the last three financial years closed before the procurement began, depending on the bidder’s establishment or start of business. The bidder must also have fulfilled at least two contracts during the 36 months before the procurement began, each for the sale, rental, hire or leasing of furniture and each worth at least EUR 70,000 excluding VAT. The bid must identify the contracts and provide their values, dates and counterparties; the contracting authority may request confirmation from the counterparties if the information is not publicly available. The bid must comply with the procurement documents, include the required furniture description, bidder declarations and bid form, and state the total contract price excluding VAT. The bidder must confirm that the furniture uses legally sourced wood and provide origin evidence at delivery; disclose REACH Candidate List substances present above 0.1% by weight and provide evidence of their presence or absence at delivery; supply disassembly and repair instructions; and provide a warranty and ensure spare parts or functionally equivalent components are available for at least three years after delivery.
