Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must declare whether it, or any person authorised to represent, manage or control it, has been convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Other grounds include failure to pay taxes or social security contributions; bankruptcy, insolvency, liquidation, an agreement with creditors, an administrator managing the bidder’s assets or suspended business activity; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement in a way that creates an unremedied competitive advantage; serious or persistent breach of a previous contract resulting in early termination, damages or comparable sanctions; and false or misleading information, withholding required information or documents, or improperly seeking confidential information. Grounds under Estonian law also include enabling the unlawful employment of a foreign national, being subject to an international sanction, and convictions for tax offences. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate in sanctioned regions. The bidder may not involve, for more than 10% of the contract value, subcontractors or suppliers who are Russian nationals, residents or entities established in Russia, entities more than 50% directly or indirectly owned by such persons or entities, or representatives or persons acting on their instructions. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The requirements apply to the relevant lot: - Lot 1: the bidder’s net turnover must have been at least EUR 500,000 excluding VAT in each of the last three completed financial years. - Lot 2: the bidder’s net turnover must have been at least EUR 300,000 excluding VAT in each of the last three completed financial years. - For both lots, during the 36 months preceding the procurement, the bidder must have properly completed at least three sales or rental contracts with legal entities for mobile phones and/or tablets. Each contract must have been worth at least EUR 10,000 excluding VAT. Framework agreements themselves do not qualify as references, but contracts concluded and completed under a framework agreement may qualify. The bidder must provide a list of contracts with their dates, values and the customer’s details. For Lot 1, the bidder must hold the manufacturer’s resale authorisation for the goods in Estonia and provide a copy of the authorisation or a manufacturer’s website reference showing its DEP reseller ID. The technical offer must be completed using the buyer’s specified form. Conditional offers are not permitted. For tablets in both lots, the offer must include a warranty of at least two years from delivery, covering repairs and a replacement product during repairs, including battery defects, at no additional charge. The offer must declare and provide evidence of REACH candidate-list substances exceeding 0.1% by weight in the product and specified components, or evidence that none are present. The bidder must provide a reuse and recycling service compliant with Directive 2012/19/EU and describe collection, confidential handling and deletion of data, and dismantling for recycling or disposal. If the bidder is not part of a producer responsibility organisation and uses a licensed waste handler, evidence of that arrangement is required; if it handles waste itself, it must provide an environmental permit for waste management. The bidder, any joint bidders and any subcontractors must be established in Estonia, another EU Member State, an EEA contracting state or a country party to the WTO Government Procurement Agreement. The offer must include the required contract signatory and contract-performance contact details, and details of any authorised representatives not listed in the commercial register. The bidder must confirm compliance with the procurement documents and explain and evidence equivalence where relevant.
