The bidder must confirm that none of the relevant exclusion grounds apply to the bidder, its management or supervisory body members, authorised representatives or other relevant persons. The grounds cover, among other things, final convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking; breaches of tax or social security payment obligations; breaches of environmental, social or labour law; bankruptcy, insolvency or liquidation; agreements with creditors; suspension of business activities; serious professional misconduct; agreements distorting competition; conflicts of interest; involvement in preparing the procurement; serious or repeated failures under previous public contracts; and false, incomplete or misleading information or failure to provide required documents. The bidder must also confirm compliance with the national exclusion grounds concerning unlawful employment of foreign nationals, international sanctions, certain local tax debts and convictions for tax offences. The tax and social security debt threshold specified in the notice is EUR 0, with the stated national-law exception for debts below EUR 100 or deferred tax debts. Where relevant, the bidder must provide details of the circumstances, final decisions, exclusion periods, corrective measures and available evidence.

The bidder must have completed newspaper delivery service contracts during the 36 months preceding the start of the procurement in at least one of the following ways: one newspaper delivery service contract with a total value of at least EUR 20,000 excluding VAT; or two newspaper delivery service contracts, each with a total value of at least EUR 10,000 excluding VAT. A reference contract may still be ongoing at the start of the procurement, provided that at least half of its contract period has elapsed and services have actually been performed in an amount corresponding to at least 50% of the applicable minimum reference value. For each reference, the bidder must provide the contract period, performance dates, a short description of the service, total contract value, value performed by the start of the procurement, the contracting authority’s name and registration code, and the name, telephone number and email address of the contracting authority’s representative. The required reference information must be submitted in the ESPD by the tender submission deadline. Joint bidders must appoint an authorised representative and upload the relevant power of attorney. The bidder must confirm that it will not use a subcontractor who would have to be replaced under the applicable national procurement rules. By submitting a tender, the bidder accepts all procurement-document conditions, and conditional tenders are not permitted.
