Compliance requirements

The bidder must confirm that the company, its management or supervisory board members, and persons representing or controlling it have not received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the illegal use of child labour or human trafficking. The bidder must also have no outstanding tax or social security payment obligations, must not allow an unlawfully staying foreign national to work, and entering into the contract must not breach an international or Estonian sanction. The bidder must confirm proper payment of taxes and social security contributions and provide relevant evidence where required. If an exclusion ground exists, remedial measures may be considered where provided for in the procurement documents or, as applicable, for a procurement above the international threshold.

Qualification criteria and exclusion grounds

Within the 36 months preceding publication of the contract notice, the bidder must have completed at least one comparable building design project as the main contractor, at least to the detailed design stage. Comparable projects include the reconstruction or new construction design of residential, office, entertainment, museum, library, educational or research buildings, hospitals or other healthcare buildings. The designed building or building section must have had a floor area of at least 700 m², and one project must meet all of these requirements. The bidder must provide the project description, value, period, client and contact details, and describe its scope of responsibility. The tender must confirm acceptance of the tender document requirements, include the price in the required structure and, where necessary, provide evidence of equivalence. In a joint tender, a power of attorney from the joint tenderers must be submitted. The bidder must identify and justify any trade secret; the tender price may not be classified as a trade secret.
