Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members or representatives have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of child labour or human trafficking offences. The bidder must also have no outstanding tax or social security payment debts, subject to the lawful exceptions described in the ESPD; the stated threshold for tax and social security debt is EUR 0. The bidder must not be bankrupt, in liquidation, subject to insolvency or liquidation proceedings, have its assets administered by a liquidator or court, or have its business activities suspended. The exclusion grounds also cover serious professional misconduct, agreements distorting competition, conflicts of interest, previous material contract breaches or early termination, false statements or failure to submit required documents, and attempts to improperly influence the contracting authority's decision-making process. The bidder must confirm compliance with environmental, social and labour law obligations and confirm that awarding the contract would not breach international or Estonian sanctions. Where applicable, explanations and evidence of measures taken to restore reliability must be provided.

Qualification criteria and exclusion grounds

Any trade secret must be identified and justified; the tender price and lot prices cannot be classified as trade secrets.
