Design services for the Tulbi Road pedestrian and cycle path

The bidder and its representatives must not be subject to exclusion grounds concerning final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must not have unpaid taxes or social security contributions, unless the obligations have been fulfilled or a binding payment arrangement has been concluded. The bidder must not be in bankruptcy, liquidation, insolvency proceedings or a comparable situation, have suspended business activities, have entered into an arrangement with creditors, or have assets administered by a liquidator or court. The bidder must not have seriously breached environmental, social or labour-law obligations, committed serious professional misconduct, entered into anti-competitive agreements, or have an unavoidable conflict of interest. The bidder must not have participated improperly in preparing this procurement, seriously or repeatedly breached an earlier public contract, submitted false or misleading information, withheld required information or documents, attempted to influence the contracting authority improperly, or obtained confidential information for an undue advantage. National exclusion grounds also cover enabling the employment of unlawfully residing foreign nationals, being subject to international sanctions, and certain convictions for tax offences. Where an exclusion ground applies, the bidder may provide evidence of measures taken to restore its reliability if permitted by the applicable rules.

The bidder must have designed at least one road construction project during the 36 months preceding the commencement of the procurement, with a value of at least EUR 30,000 excluding VAT. The project is considered designed if a building permit has been issued for it. The project must have been completed, handed over to and accepted by the client within the specified 36-month period, and the building permit must have been issued before the tender submission deadline. At least one completed project must be submitted, including its value, completion date, building permit number and the other contracting party’s contact details. The bid must comply with the procurement documents and the required price-submission structure. The bidder must also confirm that it has the funds to provide the performance guarantee. If a joint bid is submitted, a power of attorney for the authorised representative of the joint bidders must be included.
