The bidder must confirm that neither the company nor its authorised representatives or relevant management, supervisory or governing body members are subject to exclusion grounds. These include final convictions within the last five years or continuing exclusion periods for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. Exclusion grounds also cover tax or social security payment arrears, breaches of environmental, social or labour-law obligations, bankruptcy, insolvency or liquidation proceedings, agreements with creditors, comparable insolvency situations, assets administered by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement that creates an advantage, serious or repeated breaches of earlier public contracts, and false or omitted information or failure to submit required documents. National exclusion grounds also concern unlawful employment of foreign nationals, international sanctions and convictions for tax offences. The bidder must provide the required declarations and, where applicable, supporting evidence. Where permitted, the bidder may describe remedial measures taken to restore its reliability.

The bidder must have designed at least one road construction project during the 36 months preceding the start of the procurement procedure. The project must have had a value of at least EUR 30,000 excluding VAT, must have been handed over to and accepted by the client, and a building permit must have been issued before the tender submission deadline. The bidder must provide the project value, completion date, building permit number and the other contracting party’s contact details. The minimum number of qualifying projects is one. The bidder must also confirm that it has the financial resources to provide a performance security equal to 15% of the remuneration. The security must be submitted within 14 days after conclusion of the contract as a bank guarantee or a deposit into the contracting authority’s account. The tender must comply with all procurement documents, conditional tenders are not permitted, and the tender price must follow the required structure. For a joint tender, a power of attorney for the authorised representative must be submitted.
