Compliance requirements
The bidder must confirm that neither the company nor its representatives are subject to exclusion grounds, including final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the illegal use of child labour and other forms of human trafficking. The bidder must also not have outstanding tax or social security obligations, unless the obligations have been paid or a binding repayment arrangement has been concluded. Other grounds include breaches of environmental, social or labour law, bankruptcy, insolvency or liquidation proceedings, agreements with creditors, administration of assets by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement that creates an advantage, serious or repeated breaches of previous public contracts, and the submission of false or incomplete information or failure to provide requested documents. National exclusion grounds also cover enabling the employment of an unlawfully residing foreign national, international sanctions, and certain convictions for tax offences. Where applicable, the bidder must provide the required explanations and evidence; self-cleaning information may be submitted where permitted.
Qualification criteria and exclusion grounds
The bidder must have designed at least one road construction project during the 36 months preceding the start of the procurement. The project must have a value of at least EUR 30,000 excluding VAT, must have been completed and accepted by the client, and a building permit must have been issued before the tender submission deadline. For the reference, the bidder must provide the value, completion date, building permit number and the other contracting party’s contact details. No specific turnover requirement is stated. The tenderer must also be able to provide the 15% performance guarantee required under the contract and must submit a compliant, unconditional tender in the required price structure. If submitting a joint tender, a power of attorney for the authorised representative must be included.
