Compliance requirements

The bidder must confirm that neither the bidder nor its management or representative persons has received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. The bidder must also have no outstanding taxes or social security contributions, subject to the statutory exceptions; the notice refers to a EUR 100 threshold and an exception for tax debts under an approved payment arrangement. The exclusion grounds also cover breaches of environmental, social or labour law, bankruptcy, liquidation or another insolvency situation, an agreement with creditors, assets under the control of a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, previous material contract breaches, and involvement in preparing the procurement in a way that creates an undue advantage. Exclusion may also result from submitting false or incomplete information, failing to provide requested documents, or improperly influencing the contracting authority's decision-making. In addition, the bidder must not be connected with enabling the employment of a foreign national without a legal basis, breaches of international or Estonian sanctions, or convictions for tax offences. Where an exclusion ground applies, the bidder may submit evidence of remedial measures restoring its reliability where this is permitted for the procedure.

Qualification criteria and exclusion grounds

The machine-readable notice does not set specific requirements for turnover, previous experience, staff composition or professional certificates. The bidder must submit the European Single Procurement Document, providing its declarations on the absence of exclusion grounds and compliance with the requirements, and must provide any evidence requested by the contracting authority. The bidder must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia, are directly or indirectly more than 50% owned by such persons or entities, or act as their representatives or under their instructions. The bidder must also confirm that it will not use a subcontractor subject to replacement under Section 122(7) of the Public Procurement Act. The tender must comply with all tender document requirements; conditional tenders are not allowed. In a joint tender, a power of attorney from the joint tenderers must be included. Trade secrets must be identified and justified, while the tender price and numerical figures corresponding to the award criteria may not be classified as trade secrets. The tender price must follow the structure specified in the award criteria and measurable indicators sheet, and the technical description form in Annex II to the tender documents must be completed. The bidder must confirm compliance with the technical specification. If the tender uses an equivalent standard, label or technical solution, the equivalence must be explained and supported by evidence; for objective reasons, the contracting authority may also accept other relevant evidence.
