The bidder must confirm that neither the company, its management or supervisory board members, nor persons authorised to represent or control it have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal use of child labour or human trafficking-related offences. There must also be no continuing exclusion obligation. Where requested, the bidder must provide the conviction details and describe any measures taken to restore its reliability. The bidder must not have outstanding tax or social security payment obligations. It must also confirm that it has not breached obligations concerning the lawful employment of foreign nationals and payment of the required wages, and that awarding the contract would not breach international or Estonian sanctions. If a tax or social security payment breach exists, the required explanations and information on payment or a binding settlement agreement must be provided.

The bidder must be registered in the commercial register of its country of establishment or in an equivalent register. For an Estonian company, the contracting authority will verify the registration itself. A foreign bidder must provide a reference to the relevant register or a certified or apostilled document that is no more than one month old on the tender submission deadline. The bidder’s average net turnover for the last three years, 2023–2025, must be at least EUR 40,000 per year. Within the 48 months preceding the start of the procurement, the bidder must have completed at least one contract for preparing a detailed design for stormwater and/or sewerage pipelines in a settlement and/or street. The procurement passport must include the contract description, value, performance period, client and contact details. The successful bidder must, upon request, prove that the work was properly completed. The project manager responsible for designing water supply and sewerage facilities must hold at least the qualification of an authorised water supply and sewerage engineer, level 8, or an equivalent European Qualifications Framework qualification, specialising in external water supply and sewerage and competent to prepare external water supply and sewerage designs. The bidder must provide this person’s details in the procurement passport and, upon request, evidence of the professional qualification. The person may be employed by the bidder or engaged as a subcontractor. The tender must comply with the procurement documents, be unconditional and follow the prescribed structure for submitting the tender price. Where relevant, explanations and evidence of equivalence must be provided. In a joint tender, a power of attorney for the joint tenderers must be included. The bidder must identify and justify any business secret; the tender price may not be classified as a business secret.
