Compliance requirements
The bidder must declare whether it or its relevant representatives have final convictions within the previous five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. Exclusion grounds also cover unpaid taxes or social-security contributions; insolvency, bankruptcy, liquidation, creditor arrangements, court or liquidator administration, or suspended business activity; serious professional misconduct; anti-competitive agreements; conflicts of interest that cannot otherwise be avoided; involvement in preparing this procurement that creates an unremediable competitive advantage; and significant or repeated failures under previous public contracts resulting in early termination, damages or comparable sanctions. A bidder may also be excluded for false or misleading information, withholding required information or documents, improperly seeking confidential information, breaches of environmental, social or labour obligations, or the specified domestic grounds concerning unlawful employment of foreign nationals, international sanctions, and convictions for tax offences. For tax and social-security debts, the stated threshold is EUR 0; the notice notes that an Estonian tax-debt certificate is not issued where the debt is below EUR 100 or payment has been deferred. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
